Equality in the workplace

Under the terms of decree no. 2019-15 of January 8, 2019 implementing the provisions aimed at eliminating the pay gap between women and men in the workplace and relating to the fight against sexual violence and sexist acts in the workplace, companies with more than 50 employees must publish, by March 1, 2020, the results of an index following an analysis of various indicators:
  • Pay gap between women and men, calculated on the basis of the average pay of women compared to men, by age group and by category of equivalent positions;
  • Difference in the ratio of individual salary increases not corresponding to promotions between women and men;
  • Percentage of female employees who received a wage increase in the year of their return from maternity leave, if such an increase occurred during the period when leave was taken;
  • Number of employees of the under-represented gender among the ten employees receiving the highest pay.

Each indicator gives a score according to a scale defined by the administration: companies must score a minimum of 75 points out of 100 to avoid
being sanctioned.
Below this threshold, corrective measures or the scheduling of financial measures to make up for lost wages must be implemented within three years: failing this, the employer may be subject to a financial penalty set at a maximum of 1% of wages and earnings as defined in the first paragraph of
Article L. 242-1 of the Social Security Code.
